A week before the hearing on her three ongoing cases, Kim Mathers had her bond revoked again and was returned to custody.
After getting her bond revoked in August following repeated violations of her release conditions, Kimwas allowed to leave the Macomb County Jail only if she went to rehab. And that she did, according to news reports that came in later.
However, at the exact same time this news was making the rounds in the media, Kim had already left the facility. According to the court documents, she reported to an inpatient treatment facility but did not stay there.
Kim had been absconding for 37 days. She left Sacred Heart Rehabilitation Center on August 26 and did not turn herself in until October 2, when she appeared before a court magistrate who cancelled the outstanding warrants and set a $5,000 bond with house arrest.
During the October 7 hearing, Mathers’ lawyer argued that she couldn’t arrange a court hearing “on multiple occasions”, so she got a magistrate to agree to modify Kim’s bond conditions.
Responding to it, Macomb County judge William Hackel III said the magistrate did not have the authority to override his previous order. He was also surprised that no bench warrant had been executed after Kim left the rehab. In his view, leaving the facility should have triggered a warrant immediately.
The hearing resulted in sending Kim to the Macomb County Jail. She may still be released from jail into an inpatient treatment facility, according to the Macomb County Prosecutor’s Office. Otherwise, she’ll stay in custody until her next court appearance on October 14. She faces two felony cases (a May OWI arrest and a July incident at her home)and sentencing in a misdemeanor case.
