On Wednesday, October 14, Kim Mathers was scheduled to appear for a probable cause conference in two felony cases and to be sentenced in a misdemeanour case. Instead, her lawyer asked to postpone the hearing and have Kim released.
Mathers’ attorney, Camilla Barkovic, requested that the probable cause conference be rescheduled as she needed more time to file multiple motions on Kim’s behalf. Despite the prosecution’s protestation, the judge granted her request this time.
However, he denied her request for release. Kim remains in jail after her bond was revoked after multiple violations, including leaving rehab, which was the only condition that allowed her to leave jail. Kim’s lawyer argued that she could get clean and follow the bond conditions at home. She said Kim had made “significant and substantial rehabilitative efforts”, including therapy, counselling, and intensive outpatient treatment.
“She has maintained complete sobriety from when she left the treatment facility up until the time she turned herself in (last week)”, The Detroit News quotes Barkovic. “She has made significant positive strides and positive progress”.
The court denied the request, and the bond conditions remain unchanged; Kim can only leave jail for inpatient treatment. “If she gets into another inpatient, out she goes”, judge Hackel said.
She participated in the hearing via Zoom from the Macomb County Jail. However, she did not say much, leaving her attorney to speak on her behalf.
As a result, Kim’s next court appearance is scheduled for a future Friday.
